The CMS requirement of providing nursing or nursing-related services in a facility to residents for compensation (under the supervision of a licensed health professional) within your most recent certification period is waived until May 11, 2023.

Home Health Aide

In March 2020, the center for Medicare and Medicaid Services' COVID-19 Emergency Blanket Waivers for the Health Care Providers (PDF) modified the requirements for completing the annual 12 hours of in-service training. The federal waiver temporarily allows HHAs to renew without submitting the required 24 hours of in-service training completed during the certification period, until the end of the first full quarter after the declaration of the Public Health Emergency (PHE) concludes. This waiver will expire on May 11, 2023.

If your HHA was renewed under this waiver you must submit the required in-service hours for this renewal period by December 31, 2023. If you fail to provide documentation of your In-Service training hours by December 31, 2023, the expiration date of your certificate will be updated to December 31, 2023, and you will no longer be able to represent yourself as a Home Health Aide.ā€‹

All HHAs wishing to take advantage of the existing waiver must renew their certification prior to May 11, 2023. CDPH encourages submission of renewal applications well as soon as possible. HHAs submitting a renewal application without completing the required annual in-service hours must write "CMS 12" visibly on the CDPH 283C (PDF) and circle it. All in service hours must be completed and submitted to the CDPH by the end of the first full quarter after the declaration of the PHE concludes, or as otherwise specified by CMS. HHA who complete their in-service hours are encouraged to submit them with their renewal application or upon completion. HHAs who do not submit their in-service hours by the CMS deadline are not eligible to provide care.
